Within the frame of the Chair for Peace, organized by the Law Faculty of Universidad de la Costa, the following conference was held: "Analysis of the Peace plebiscite", by Licentiate Diego González, a Constitutional Law Professor of Universidad Externado de Colombia. Lawyer and Master in Law of the same University. As a Fulbright scholarship grantee, he obtained the title of Law Master of the University of California, Berkeley, Boalt Hall.
During his intervention, Licentiate Diego González spoke about the citizen participation mechanisms, which are a series of established tools on the 1991 Constitution to ensure and promote the mobilization of the Colombian population.
He also referred to Law 134, 1994, that regulates everything about said mechanisms, including: legislation and normative public initiative, referendum, public consultation, mandate recall, plebiscite and open council.
He explained besides, each of the referenced mechanisms and asserted that all with voting capacity individuals in our society, have the right to practice the use of the participation mechanisms to ensure their participation in the decision making and resolution of problems affecting the common wellbeing.
He affirmed that the plebiscite is a tool used by the Presidency of the Republic to back a decision with the opinion of the people. The President announces the use of the plebiscite and citizens vote to endorse or reject the proposed decision. While the referendum is a tool used to convoke citizens for the approval or rejection of a Law Project or a current juridical norm. The referendum might be national, regional, departmental, district, municipal or local.
